JAKARTA | In accordance with Law Number 23/2014 on Regional Government, it is stated that the authority over the establishment deed, amendments to the articles of association, and dissolution of cooperatives lies with the Central Government. "In relation to this, to enhance, accelerate, and simplify services to the public, especially regarding institutional status and administrative order of cooperative legal entities, these activities are carried out online," said Deputy for Institutional Affairs of the Ministry of Cooperatives and SMEs, Choirul Djamhari, during the trial of online legal entity approval in Bogor City, Friday (11/3).
For this reason, Choirul continued, the Minister of Cooperatives and SMEs issued Ministerial Regulation Number 10 of 2015 on Cooperative Institutions. Article 45 of the regulation states that the Minister delegates the approval of the Establishment Deed, Amendments to the Articles of Association, Mergers, Consolidations, Divisions, and Dissolutions of Cooperatives to the Deputy for Institutional Affairs, which is carried out electronically. "The Ministry of Cooperatives and SMEs has prepared a platform or service availability through the SISMINBHKOP website (Online Administrative System for Cooperative Legal Entities)," Choirul added.
To achieve this, Choirul emphasized that the role of notaries is very significant. In addition to serving the creation of authentic cooperative establishment deeds, they are also responsible for drafting other deeds related to institutional affairs and cooperative business transactions that require authentic documentation.
Data from the Ministry of Cooperatives and SMEs records approximately 9,887 Notaries for Cooperative Deeds. Ministerial Decree Number 98 of 2004 on Notaries as Cooperative Deed Makers states that notaries who meet the requirements and wish to obtain a Decision Letter/Certificate as a Notary for Cooperative Deeds (NPAK) must submit a written application to the Minister, c.q. Deputy for Institutional Affairs. "This must be accompanied by a Notary Appointment Decision Letter and a certificate proving participation in cooperative training," said Choirul.
Choirul hopes that this system can serve the public in registering new cooperatives or making amendments to the Articles of Association, ensuring that they can operate under legal protection. "In terms of efficiency, this system is expected to facilitate and expedite the legal entity service process," he stated.
For the Ministry of Cooperatives and SMEs, this system will also simplify the management and processing of cooperative data. "Therefore, we hope for good support and cooperation between the Ministry of Cooperatives and SMEs and notaries in implementing this system," said Choirul.
Choirul explained that before the official launch on April 8, 2016, several preparatory tasks need to be completed. These include overall system security enhancements, an easy-to-use online support system with chat and ticketing features, the addition of a cooperative decree verification mechanism using barcode scanner web services, and improved system accountability. "This also includes the addition of a linking history mechanism for PAD with previous cooperative entities and features for decree data correction," Choirul added.
Secretary of the Ministry of Cooperatives and SMEs, Agus Muharram, stated that the online cooperative legal entity approval system is part of the comprehensive cooperative reform. "This aligns with one of the cooperative reform strategies, which is cooperative reorientation, where we focus more on developing cooperatives in terms of quality rather than quantity," said Agus.
Furthermore, Agus stated that the online system in the national cooperative sector aligns with President Jokowi’s initiative for Indonesian economic players to enter the digital era.
